Taking into consideration that, in line with the Law on Protection of Personal Data, we are obliged to provide you with all necessary information in a clear and transparent manner, we have drafted this Privacy Policy (hereinafter: the Policy). We are very committed to protecting your privacy. Moreover, the safety and satisfaction of our customers, clients and natural persons with our business partners (hereinafter: the Data subjects) are our priorities.

Who controlls your personal data?

Mionè is the controller of your personal data, i.e. an entity which determines the purpose and manner in which personal data are processed, in terms of the Law on Protection of Personal Data.

In order to facilitate and provide for the easiest manner in which you may exercise your rights, we have designated a person in charge of personal data protection. Definitions used in the Policy

‘Data subject’ or ‘You’ refers to all natural persons who share their personal data with us, regardless of whether they are our Website users, guests, customers, or registered users.

‘Website’ refers to the website at the following address mioneatelier.com.

‘Website user’ refers to any person who accesses the Website, regardless of whether said person registered or ordered products via our Website.

‘Registered User’ refers to a person who has a registered account on the Website.

‘Guest’ refers to a Customer who orders a product without registering an account on the Website.

‘E-store’ refers to online sales conducted via the Website, and which offers Mionè products.

‘General Terms and Conditions’ refer to conditions under which business operations are conducted and which constitute an integral part of an agreement concluded with Mionè and which are available on the Website.

‘Processor’ refers to a natural person or a legal entity that processes your personal data on behalf of the Controller.

‘Data’ refers to personal data, i.e. data pertaining to a natural person whose identity is determined or determinable, directly or indirectly, on the basis of such data. Personal data does not refer to data pertaining to entities such as legal entities, animals and the like. However, if certain data may lead to the identification of a natural person, such data is considered to be personal data (for instance, data on entrepreneurs or single-member companies which include data in connection with a natural person). Data in connection with business activities of natural persons are also included, such as e-mail addresses of employees in legal entities, which have the following form: name.surname@company.com, and which may easily lead to the identification of a natural person.

‘Commissioner’ refers to the Commissioner for Information of Public Importance and Personal Data Protection, Bulevar kralja Aleksandra 15, 11000 Belgrade, e-mail office@poverenik.rs.

‘Cookies Policy’ refers to particular rules regarding the use of cookies to collect certain personal data on the Website, and these rules are an integral segment of the Privacy Policy.

‘Controller’ refers to Mionè as an entity which determines the purpose and manner in which personal data are processed.

‘Consent’ refers to your unambiguous agreement to have your personal data processed. Any person over 15 years of age may independently grant his/her consent to his/her data being processed when using information company services. Persons under 15 may grant their consent via their parents/guardians. Consent is just one of the legal bases for data processing; therefore, data may be processed based on other grounds.

‘Law’ refers to the Law on Protection of Personal Data of the Republic of Serbia.

Other terms used in this Policy are written with capital letters are defined in the General Terms and Conditions.

Policy application

This Policy is, accordingly, and in relevant segments, applied to the following Data subjects:

a) Website users, regardless of whether they are Guests or Registered users,
b) Customers.

Please, bear in mind that the Policy only applies to data in connection with a natural person, as defined in the ‘Definitions used in this Policy’ section.

Mionè particularly cares about the privacy and safety of minors on the Internet, therefore, we will not collect or process data related to persons under 15 years of age. Such persons should not reveal their personal data to us. If you believe that we have collected any data about persons under 15, please, notify us immediately at privacy@mioneatelier.com, and Mionè will undertake all necessary measures and procedures to correct a potential mistake.

How and when does Mionè collect your personal data?

There are several ways in which Mionè may collect your data.

We usually collect data directly from you – when visiting Mionè Website, when purchasing and/or ordering products from us, when you contact us for customer support or when your data is otherwise relevant to the purchase, i.e. our business, which is why you share your data with us directly.

Mionè pays special attention to data collected for marketing purposes. Processing your data for marketing purposes will be conducted exclusively based on your prior, explicit consent. You will always be informed of such data processing, so you may, at any time, withdraw your consent. For more information, please refer to the ‘Your rights’ section.

Certain data will be collected automatically when you access our Website. These data include IP address, type of device, type of search engine and other technical information. Said data are typically collected via cookies or other similar technologies, as described in detail in the Cookies Policy. We need most of the data to provide you with better user experience on our Website. If you wish not to share necessary personal data, we are not able to guarantee that information and services you receive will fully satisfy your needs.

If you wish to purchase Mionè products via our e-Store or use additional functionalities of our Website, please register an account on the Website. User account registration is not mandatory, and you can always delete your account.

Without such data, user registration is not possible, but a sales agreement could be concluded and executed if the Consumer, who is a natural person, makes the purchase as a Guest. In other words, registration is not required to purchase our products.
Order processing

In order to process your order and deliver the product, it is necessary for you to share with us certain personal data, which are necessary for the execution of the sales agreement. Therefore, we need the data to conclude and execute agreements, to charge for products, to deliver products, as well as to manage and receive complaints, claims and reclamations.

Name and surname, e-mail address, telephone number, city/town, postal code, street and number, and if you opt for electronic payment, we will also collect data about your payment card number, your bank and your current account number.Processing is necessary for the execution of a sales agreement which we conclude with you or for taking action, at your request, prior to concluding the agreement.

Without such data, we would not be able to conclude or execute the agreement.

 

Monitoring patterns of behaviour, creating and sending personalized offers

When making orders on the Website, you can agree to us following your patterns of behaviour, based on which Mionè creates and sends you personalized offers. In this way, based on your consent, we monitor the data pertaining to your previous purchases and create personalized offers, i.e.  offers that we believe you will be interested in.

We use data collected during order processing. Subsequently, we collect data on realised purchases to determine patterns of your behaviour and recommend products we believe you would be interested in.We use your data for this purpose only on the basis of your explicit consent, granted during the account registration process or when making a purchase. You are not obliged to give your consent, in which case we will not monitor your behaviour or send you personalized offers.

Loyalty program

For the most faithful customers, Mione has organized a loyalty program which offers a series of different benefits. In order for Mione to be able to issue loyalty cards and keep records of the cards’ users, we collect your data when you join the program.

We use data collected during the registration of your account on the Website.Data processing is necessary for the performance of a contract concluded with a data subject who is the beneficiary of our loyalty program. Without said information, we will not be able to identify you and ensure that you enjoy the benefits of our loyalty program.
Conducting surveys for the needs of Mionè business operations and research on satisfaction with our products and services.

When registering your account on the Website, you may select the option to grant your consent that Mionè may contact you to conduct surveys and research on satisfaction with our products. Your consent is not mandatory, and account registration and/or purchase will be enabled, regardless of whether you granted your consent or not.

Consumer support

Should you require any support regarding the products you ordered or your user account, you may contact us via Website, e-mail or telephone (for instance, to obtain additional information, to inquire about a manner in which you may exercise your rights, to make additional inquiries, lodge complaints, exercise the right to cancel the order or exchange an article and the like). In these situations, we will require your data to offer assistance, i.e. resolve the issue you reported.

We collect the following data: name and surname, telephone number, e-mail address, current account number and home address for the purpose of responding to complaints, as well as other data pertaining to the issue you contacted us about, all of which you decide to submit.Data processing is necessary to fulfil legal obligations, i.e. provide customer support. Processing is conducted based on our legitimate interest, as data are used to give you necessary or useful information in connection with your request or question submitted to our Customer Support Service.

E-mail address.Data processing is conducted for the purpose of achieving our legitimate interests, but also Customer interest, to create transparency towards Customers, thus allowing them to decide whether these amendments affect them. Without your data, we will not be able to directly inform you about amendments of these acts, but you will be able to find notifications on such amendments on our Website.

In addition to the aforementioned data, certain personal data are collected via cookies, in accordance with the Cookies Policy.

How and where are your data stored?

We keep your data safe from any unauthorised or unlawful processing, accidental or unlawful loss, change, i.e. access to your personal data. Therefore, we have implemented adequate technical and organisational measures, such as control over physical access to your data, data encryption, and unique user name and password safety. However, please bear in mind that we are unable to completely eliminate all risks in connection with your data storing, as data safety on the Internet can never be 100% guaranteed. Nevertheless, Mionè will undertake all measures available to keep your personal data safe.

All monetary transactions on our Website will be conducted via safe payment systems. Confidential payment data are transmitted directly in the form of encryption (SSL or TLS) to the correspondent. You will recognise encryption when you see that your web browser address is changed from ‘http://’ form into the ‘https://’ form and a padlock symbol appears in the address field. When SSL and/or TLS encryption is activated, third parties are unable to access data.

Most data will be stored in electronic form and standard safety principles and procedures will be applied.

Personal data Processors

To provide you with fast, convenient and safe shopping experience, Mionè uses third-party services, which help us to adhere to the highest standards in our service provision. The third parties we engaged are the Processor.

The Processors include service providers we engage to provide legal and accounting services, as well as delivery services. When you make a purchase via our Website, your personal data are transmitted to the Processors only when it is necessary in order to fulfil our contractual obligations. For instance, necessary data are revealed to courier services which deliver ordered goods to your home address.

In accordance with agreements we conclude, all Processors are under the obligation to use data they are entrusted with, exclusively in line with our instructions, and strictly for the specified purposes. The Processors are obliged to ensure confidentiality of said data and they are liable for the safety thereof.

In some cases, personal data may be transferred from the Republic of Serbia to servers in other countries. The servers we use have adequate levels of protection of personal data as envisaged under the EU General Data Protection Regulation (GDPR), so the level of protection of personal data is (at the minimum) equal to the one in Serbia.

When data is transferred outside the EU, we ensure that these countries maintain an adequate protection level of personal data. For example, when Processors are located in the United States of America, we ensure that Processors are EU/US Privacy Shield Framework Participants.

How long does Mionè store your data?

Mionè stores your data for as long as there is a purpose and legal basis for doing so, in accordance with the Law. Personal data, collected to exercise rights and fulfil contractual obligations, will be processed for the duration of such contractual relation with the data subject, except in cases when we are obliged to keep such data for the duration of the time prescribed under relevant laws, in accordance with the consent from the data subject or legitimate interest (for example, in the event of court proceedings involving us and the data subject).

Should court proceedings, administrative or out-of-court settlements be initiated, personal data may be stored for the duration of such proceedings.

Data collected solely for the purpose of providing sales transactions, i.e. for the execution of agreements, are stored for additional 12 months from the date of the last transaction (for example, shipping transaction, delivery, complaint, etc.) or from the expiration date of the legally prescribed deadline for complaints, whichever date is later.

Personal data which are processed exclusively based on your consent, we process in accordance with the purpose for which they were collected, i.e. until the withdrawal of your consent. For example, if you unsubscribe from receiving our Newsletter, we will delete the data on your e-mail address, unless it was shared with us for other purposes as well. You may withdraw your consent at any time, in accordance with the Your Rights section.

Your Rights

As a data subject, you are granted the following rights, in accordance with the Law:

Right of Access

You are entitled to submit a request for information about whether your personal data are being processed. If your personal data are being processed, you may request a copy of any and all such data, at any time. You may submit the request at the following e-mail address: privacy@mioneatelier.com.

The requested information will be delivered to you within 30 days from the receipt of your request. When obtaining such information is complex or justifiably requires more time, this period may be extended for additional 60 days. However, this pertains only to exceptional circumstances, and during this process you will be duly informed about any delay and reasons for such delay.

You will be notified, within 30 days, about the reasons for rejecting your request as well as about the right to lodge a complaint to the Commissioner, in the event that we reject your request for obtaining data.

Right to Rectification

All data we process are inspected and verified as correct, and they are regularly updated, whenever it is possible. If you believe that the data are incorrect or they change, you have the right to request their correction, by submitting a request at the following e-mail address: privacy@mioneatelier.com.

Right to be Forgotten (Data Deletion)

You are entitled to request deletion of your personal data, except in the event that we are legally bound to keep such data or there are legal bases for rejecting your request (for example, submittal, exercise or defence of a legal claim). Right to Limit Data Processing

In certain processes, you may limit our and/or third parties’ access to your data, or in certain situations, restrict the access entirely. This option is available should you dispute the accuracy of the data, and within a deadline which allows us to verify their accuracy, or if you consider that we no longer need the data for processing purposes, or you have lodged a complaint with the Commissioner during the assessment of overriding legitimate interest.

Right to Complaint

You have the right to file an objection to the manner in which we controll your data, if the data processing is based on our legitimate interest. In addition, you have the right to submit an objection, at any time, to the processing of your data for the purpose of direct marketing, which includes profiling to the extent that it is associated with such direct marketing.

Right to Withdraw Consent

If data processing is based on your consent, you may withdraw your consent at any time.

Consent withdrawal will not affect the lawfulness of data processing based on consent prior to its withdrawal.

Entry into force of Policy Amendments

This policy is effective as of 08.06.2020.

We will regularly review and update information about personal data processing in accordance with modifications in our business processes or based on obligations arising from relevant legislation.

The valid version of the Policy will always be available on the Website in a visible location and updated Policy rules will be applicable as of the moment when the updated version of the Policy becomes available on the Website. Should any significant amendments be made, which affect personal data processing to a greater extent, such information will be promptly published on our Website and a notification will be sent to your e-mail address, if we dispose of such data.
