GENERAL TERMS AND CONDITIONS FOR ONLINE SALES

The following are General Terms and Conditions that apply to every purchase made through Mione website. Please read the following terms and conditions carefully before making a purchase at our e-shop to learn about your consumer rights and obligations. By ordering and purchasing products via our website, you confirm that you are familiar with and accept these General Terms and Conditions.

By making a purchase through our website, you are entering a Distance Contract with JELENA JOVANOVIĆ PR PROIZVODNJA OSTALE ODEĆE MIONE ZRENJANIN headquartered at Metohijska 1, Zrenjanin, company number: 65703980, tax identification number: 111852037 to which the provisions of the Law on E-Commerce, the Law on Consumer Protection, the Law on Commerce, the Contractual Relations Act and other applicable law of the Republic of Serbia apply.

Mione reserves the right to amend these General Terms and Conditions at any time. It is, therefore, necessary to read these General Terms and Conditions before each purchase/order made through our website in order to make yourself familiar with potential changes.

These Terms and Conditions apply to purchases from abroad (outside the Republic of Serbia) unless otherwise stated.

Definitions

“Seller”, “We” or “Mione“ refers to JELENA JOVANOVIĆ PR PROIZVODNJA OSTALE ODEĆE MIONE ZRENJANIN, headquartered at Metohijska 1, Zrenjanin, company number: 65703980, tax identification number: 111852037, phone number: +381 63 8610052.

“General Terms and Conditions”, “Conditions” or “GTC” refer to the general terms and conditions for online sales at our e-shop, via our Website.

“Customer” or “You” shall refer to any natural or legal person ordering product(s) from our Website or looking to order product(s) from our Website.

“Website user” shall refer to any person visiting and browsing our Website.

“Guest” refers to any Customer who purchases our products without registering on our Website.

“Registered user” refers to any Website User with a registered account on our Website.

“Consumer” shall refer to any natural person who procures goods or services for purposes other than professional or commercial activity, and to whom consumer protection legislation applies.

“Purchase contract” or “Contract” refer to the distance contract for any product and/or service offered by the Seller, to which GTC and any specific conditions agreed between the contracting parties apply.

“Website” refers to Mione website, available at: mioneatelier.com.

“Privacy Policy” refers to the document that discloses the way your personal data are processed. You can access the  Privacy Policy by clicking here.

“Cookie Policy” refers to a specific section of the Privacy Policy that discloses rules on data collection via the Website using cookies. You can learn more about the Cookie Policy here.

“Contracting Parties” refers to the Customer and the Seller.

General provisions

These General Terms and Conditions concern the Seller’s entire operation, including its offer, order confirmation, delivery and receipts, and any other sales-related document.

Any special condition not covered by the GTC, particularly the conditions set by the Customer, will be binding only if they are explicitly agreed upon and confirmed by the Seller in writing.

The Website and e-shop Mione are not intended for persons under 15 years of age.

If the Customer is a legal person, the person entering the data and ordering products thereby confirms and guarantees that they are authorised to conclude the purchase contract in the name and on behalf of said legal person.

The rules of these GTC that apply solely to Consumers shall be explicitly indicated. The provisions of General Terms and Conditions tha apply to Consumers, cannot be applied to legal entity Customers.

Ordering

Our products can be ordered only through the Website. We don’t offer the option to place orders via telephone.

Customer can place an order either as a Guest or as a Registered User. Once registered, the account can be used to place orders in the future.

After you find a product you like and decide to buy it, you can place an order by clicking the Add to Cart button. The items in your shopping cart can be updated or changed at any time before the order is confirmed.

After you add all products you want to buy to the shopping cart, you need to enter your data into a specially designed form. The order is confirmed by clicking the Checkout button.

As a Customer, by confirming the order on the Website you also confirm that:

1. You are aware of the General Terms and Conditions, i.e. that you had a chance to read them,
2. Before confirming the order on the Website, Mione has provided you with all relevant information in a clear manner in accordance with its obligation to notify the Customer about all necessary information,
3. You agree to the General Terms and Conditions as a Customer.

The obligation to notify within the meaning of item 2 includes information about:

• Basic characteristics of goods;
• The Seller—business name, company number, address and phone number;
• Purchase price, the way purchase price is calculated and additional costs, such as delivery costs covered by the Customer;
• Payment method, delivery method and deadlines, and the manner in which other contractual obligations are met;
• How and where claims can be filed and the manner in which the Seller handles them;
• Legal liability in case of nonconformity of products;
• Conditions concerning Customer’s rights regarding nonconformity;
• Conditions for termination of the Contract.

After placing an order, an automatically generated email will be sent to the email address provided in the order form, confirming your order. Once we receive your order and once the goods are ready, we will notify you via email about the expected delivery date.

Prices

The price of each product in dinars (RSD) is indicated next to the photo of the corresponding product on the Website. The price of each product in euros (EUR) is indicated next to the photo of the corresponding product on the English version of the Website. The Seller is not registered for VAT.

The prices indicated on our Website are valid only for online sales.

Delivery costs are included in the price of the product up to a certain amount. For more details on delivery costs see the section “Delivery.”

Payment

Orders placed through the Mione e-shop can be paid electronically, using debit or credit cards.

In case of returned goods, the online seller will refund the money to the Customer’s bank account.

Delivery

Products ordered through our Website will be delivered via Post Express courier service, or  Post Export courier service for orders placed from abroad.

Ordered products will be delivered to the Customer or the person indicated as the consignee within 7 business days, but no later than 30 days from the date of receiving the order on the teritory of Serbia. Europe delivery aim—10 business days from the date of order confirmation. Worldwide delivery aim—15–20 business days from the date of order confirmation.

Customer will be provided with the tracking number, so he can “track and trace” his order anytime he likes. For tracking, please follow the link.

All orders are processed and dispatched within 48 hours from the date of the order. Packages are not delivered on weekends, holidays, or official non-working days. The delivery for orders in Serbia is done between 8:00 and 19:00.

The package is delivered to the address indicated by the Customer on the order form.

Delivery is free for orders over 80 EUR. For orders under 80 EUR, delivery costs are borne by the Customer according to pricelist of the international courier service Post Export, which operates as part of the Post of Serbia.

The Seller shall not be liable for any fees that may arise as a result of customs and tax regulations in the country of destination. Please check the customs and tax regulations of the country of destination before ordering.

Once a package is delivered, the risk of accidental loss, damage, or destruction of the goods is passed from the Seller to the Customer.

If you decide to return the purchased products or replace them for a different item, the Customer shall bear the cost of return of the originally purchased product according to the Post Export courier service or any other courier service you choose.

a. Delivery process

During the delivery, the Customer is obliged to inspect the packaging for any visible damage in the presence of the courier.

Should the Customer find a visible damage to the packaging, the Customer is obliged to demand the package to be opened to check for any visible damage to the product.

If the product is indeed defective, the courier will make a record of damage.

When receiving the package, the Customer is obliged to sign the despatch note (i.e. shipping invoice), which is retained by the courier service as a delivery receipt. By signing the despatch note, the Customer confirms that he or she has received other documents accompanying the goods. The Customer is obliged to report any transportation damage within 24 hours of receiving the goods.

b. Order cancelation

The Customer reserves the right to cancel the order at any time by sending an email at info@mioneatelier.com.

If the order is cancelled before the despatch, the Customer is entitled to a full refund, including the product purchase price and delivery costs.

If the Customer cancels the order after the Seller has dispatched the package, the Customer is entitled to a refund of money paid for goods but must bear the costs of returning the goods to the Seller.

Upon cancelling the order via email, the Customer will receive a cancellation confirmation email.

Product replacement

Should you determine that, upon receiving the goods, the product is not the right size or colour, or you wish to replace it for a different product, you can contact us via email at info@mioneatelier.com or telephone at +381 63 8610052.

Delivered products can be replaced within 14 days from receiving the products.

If you wish to replace a product, Mione will send you the necessary forms to your email address. When you receive the forms, you have to print and fill them out legibly and send them together with the received product at: Jelena Jovanovic PR Mione, Metohijska 1, 23000 Zrenjanin, Serbia.

Please ensure that the item you are returning is properly packaged, and that is has no signs of wear and tear. The sender, i.e. the Customer, will be solely responsible for any transportation damage inflicted on the goods before they reach the Seller’s premises.

If the returned product is properly packaged and in new, unused condition, we will immediately send a replacement product to the Customer’s address with a new despatch note (i.e. shipping invoice).

Improperly packaged products, as well as products returned to the Seller in a defective or used condition, will not be eligible for replacement.

The costs of returning the goods shall be borne by the Customer, except in cases when the product received does not correspond to what the Customer ordered or there are defects on the goods for which the Seller is responsible.

The Seller reserves the right not to accept the returned product if it is found during the inspection that it was used or damaged by the Customer.

Consumer’s right to withdraw from the contract

The Law on Consumer Protection applies to any purchase made through Mione e-shop. The following section of the GTS refers to Customers who are natural persons, i.e. Consumers.

Consumers are entitled to withdrawing from the Contract within 14 days from the delivery without any obligation to give any reason.

If there are several items on your purchase order that haven’t been delivered to you at the same time, the contract withdrawal deadline begins with the day of the of receipt of the last product.

The right to withdraw from the Contract is exercised by sending a written statement of withdrawal to the Seller’s address. This can be done either by filling out the contract withdrawal form delivered together with the goods, or in any other unequivocal manner, including email.

The statement of withdrawal becomes legally effective on the day it is submitted. If you submit your statement of withdrawal in electronic form, we will notify you that we have received your request in writing or any other durable medium without delay.

If a Customer withdraws from the Contract, he or she will be obliged to return the goods to the Seller without delay, and no later than 14 days from the day of sending the statement of withdrawal. Items must be returned in new and unused condition, in original and undamaged packaging. The receipt (i.e. shipping invoice) must be returned together with the purchased items. The Customer bears all return shipping costs.

In case of withdrawing from the Contract, the Consumer is entitled to a refund or product replacement if both the goods and the packaging are returned to the Seller undamaged and supplemented with the receipt (i.e. shipping invoice). The money paid will be reimbursed to the Consumer upon the delivery of the goods to the return address. Mione will without delay reimburse the Customer in full, including the shipping costs, no later than 14 days from the day of receipt of the statement of withdrawal. The reimbursement may be delayed until we receive the returned goods or until you produce a proof of postage.

The Customer will be solely responsible if the value of the goods is diminished by any amount as a result of the handling of the goods by the Customer beyond what is necessary to establish the nature, characteristics and functioning of the goods. In such a case, Mione reserves the right to deduct that amount from the amount to be reimbursed to the Customer.

The Customer will not be entitled to contract withdrawal:

1. for the provision of services after the service has been fully performed, provided that the performance has begun with the consumer’s prior express consent, and with the acknowledgement that he will lose his right of withdrawal once the contract has been fully performed by the trader;
2. for the supply of goods made to the consumer’s specifications or clearly personalised.
